The Internet Corporation for Assigned Names and Numbers has revealed that it received over 1,000 applications. Borden Ladner Gervais??Intellectual Property Alert??urges trademark rights holders to ?take this opportunity to review the list of gTLDs?and consider filing legal rights objections to any gTLD that contains, or may be confusing with, the rights holder?s common law or registered trademarks.?
BLG also lists various considerations regarding filing an application including similarity of the gTLD to the trademark holder?s mark in appearance, sound, or meaning; whether there is recognition in the relevant sector of the public of the mark corresponding to the gTLD as the mark of the holder, the gTLD applicant or a third party; whether the gTLD applicant is commonly known by the proposed gTLD; whether the applicant?s intended use of the gTLD is likely to create confusion with the holder?s mark as to source, sponsorship, affiliation or endorsement; and determining the applicant?s intent in applying for the gTLD.
